California Privacy Statement

Effective: June 16, 2025

This California Privacy Statement ("California Statement") supplements the Absolutely Ridiculous Privacy Statement and applies solely to visitors, users, and others who reside in the State of California ("consumers" or "you"). Absolutely Ridiculous, LLC ("AR," "we," "us," "our") has adopted this California Statement to comply with California privacy laws, including the California Consumer Privacy Act ("CCPA") as amended by the California Privacy Rights Act ("CPRA"). Any terms defined in the CCPA that are not defined here have the same meaning when used in this California Statement.


1) Notice of Collection and Use of Personal Information

We collect information that identifies, relates to, describes, or could reasonably be linked with a particular consumer or household ("personal information"). We may also collect data that is not identifiable to you, such as aggregated data, which is not considered personal information under this Statement. To the extent such data is stored or associated with personal information, it will be treated as personal information.


Categories of Personal Information Collected

Within the last twelve (12) months, we have collected the following categories of personal information:

  • Identifiers, such as name, postal address, email address, IP address, account name, and other similar identifiers
  • Personal information categories listed under the California Customer Records statute (Cal. Civ. Code 1798.80(e)), such as name, address, telephone number, and financial information including credit and debit card numbers
  • Commercial information, including records of products or services purchased, obtained, or considered, and other purchasing or consuming histories
  • Internet or other electronic network activity information, including browsing history, search history, and information regarding interactions with our Site, emails, or advertisements
  • Geolocation data
  • Audio, electronic, or visual information, such as CCTV footage from our Nashville retail location or pop-up events, or social media profile images
  • Inferences drawn from the above information to create a profile reflecting consumer preferences, characteristics, and behavior
  • Sensitive personal information, such as precise geolocation data


We will not collect additional categories of personal information beyond those listed above without providing you with a new notice at or before the time of collection.


Use of Personal Information

We collect and process your personal information for the following business and commercial purposes:

  • Providing you with information tailored to your requests, responding to inquiries, and delivering products and services
  • Marketing, including sending messages about AR, our products, collaborations, events, and special offers — which may be tailored based on your preferences or activity such as an abandoned cart
  • Operating, maintaining, and improving the quality and security of the Site and our Services
  • Communicating with you by email, SMS, or push notification — with your consent where required — about orders, products, and other topics
  • Complying with applicable laws, regulations, and requests from law enforcement or governmental agencies
  • Protecting our rights, property, and safety, and those of our customers and partners
  • Other purposes as permitted or required by law


We will not use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you with notice.


Sources of Personal Information

We collect personal information from the following sources:

  • Directly from you, when you provide it through our Site, in-store, or at pop-up events
  • Automatically through logging and analytics tools and as a result of your use of the Services
  • Data analytics providers, such as Google Analytics, through cookies, pixels, and tracking technologies
  • Service providers we engage for shipping, returns, customer support, fraud prevention, and email marketing (including Klaviyo)
  • Third-party sources, including payment processors, fulfillment providers, and social networks through your interactions with us on social media


Sale or Sharing of Personal Information

We do not sell or share your personal information as those terms are defined under the CCPA. Within the last twelve (12) months, we have disclosed the following categories of personal information for business purposes with the following categories of third parties:

Retention of Personal Information

We retain personal information only as long as necessary for the purposes described in this Statement and our Privacy Statement, including compliance with applicable laws and regulations, and to protect our legal rights and those of our customers and partners.

After the relevant retention period, personal information will be archived, anonymized, or deleted as permitted by applicable law. Archived information may be retained and processed to the extent required by legal obligations, dispute resolution, or regulatory requirements.


2) Your California Privacy Rights

California Civil Code Section 1798.83 ("Shine the Light" law) permits California residents to request information about personal information disclosed to third parties for their own direct marketing purposes in the preceding calendar year. Such requests may be made once per year, free of charge, by contacting us at the information provided at the end of this Statement.

We do not disclose personal information to third parties for their own direct marketing purposes.


Under the CCPA as amended by the CPRA, California residents have the following rights:


Right to Know

You have the right to request that we disclose certain information about the personal information we have collected, used, disclosed, and shared about you in the past 12 months, including:

  • The categories of personal information collected about you
  • The categories of sources from which we collected your personal information
  • The categories of personal information shared or disclosed for a business purpose
  • The categories of third parties with whom personal information was shared or disclosed
  • Our business or commercial purpose for collecting your personal information
  • The specific pieces of personal information we have collected about you


Right to Data Portability

You have the right to request a copy of the personal information we hold about you in a portable, readily usable format where technically feasible.


Right to Deletion

You have the right to request that we delete the personal information we have collected from you, subject to certain exceptions. We may retain personal information where necessary to:

  • Complete a transaction or fulfill a service you requested
  • Detect and protect against security incidents, fraud, or illegal activity
  • Debug and repair errors affecting existing functionality
  • Comply with a legal obligation
  • Otherwise use the information lawfully and compatibly with the context in which you provided it


Right to Correct

You have the right to request correction of inaccurate personal information we hold about you. Upon verification of your request, we will use commercially reasonable efforts to correct the inaccurate information.


Right to Restrict Sensitive Personal Information

You have the right to restrict the use and disclosure of sensitive personal information to certain purposes as defined under the CCPA.


Right to Opt-Out of Sale or Sharing

You have the right to opt out of the sale or sharing of your personal information. We do not sell or share your personal information as defined under the CCPA. We do not and will not knowingly sell or share the personal information of consumers under the age of 16 without affirmative authorization.


Right to Non-Discrimination

You have the right not to receive discriminatory treatment for exercising your CCPA privacy rights. Unless permitted by law, we will not deny you goods or services, charge different prices, provide different levels of quality, or suggest that you may receive different treatment as a result of exercising your rights.


Right to Opt-In to Financial Incentives

You have the right to opt in to any financial incentives we offer related to the collection of personal information, and to opt out at any time. See the "Notice of Financial Incentives" section below for more information.


3) Submitting a Verified Consumer Request

To exercise your Right to Know, Data Portability, or Right to Deletion, you must provide sufficient information to verify your identity and describe your request in enough detail for us to properly understand and respond. We will verify your identity using at least two pieces of identifying information, such as your name, address, or account email.

Only you, or a person you have authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may submit a Right to Know or Data Portability request no more than twice within a 12-month period.

We will acknowledge receipt of your request within ten (10) business days and respond within forty-five (45) days. If additional time is required (up to 90 days total), we will notify you in writing with the reason and expected timeline. We will not charge a fee for processing your request unless it is excessive, repetitive, or manifestly unfounded.


Requests by an Authorized Agent

If an authorized agent submits a request on your behalf, we require verification of the agent's authority to act on your behalf, which may include written permission from you, a power of attorney, or other documentation. We will also verify the identity of both the agent and the California resident on whose behalf the request is made.


Do Not Track

We do not currently respond to web browser Do Not Track signals or similar mechanisms. Please refer to our Cookie Policy for information about how to opt out of certain tracking technologies.


4) Notice of Financial Incentives

From time to time, AR may offer financial incentives related to the collection of personal information, such as a discount or promotional offer in exchange for signing up for our email or SMS list.

Customers who sign up for email or SMS communications may receive a promotional code or offer on their next purchase. You may opt in by providing your email address and/or phone number, and you may withdraw your consent at any time by clicking "Unsubscribe" in any of our marketing communications or contacting us directly.

We do not generally assign a fixed monetary value to personal information. To the extent required by law, we have valued the personal information collected in connection with financial incentives as being reasonably equal to the value of the discount or incentive offered, calculated in good faith based on the categories of personal information collected (e.g., email address, phone number), the value of the discount offered, and the estimated value of the associated purchase.


5) Modifications and Updates

We reserve the right to modify this California Statement at any time. Changes will be effective upon posting of the revised Statement. Your continued use of the Services following any such update constitutes your acknowledgment of the amended California Statement.
